Can my spouse work in the USA while I am on an H-1B visa?

My wife will come with me to the US on an H-4 dependent visa. I have heard there is some way for her to get a work permit but the rules keep changing. What is the current situation for H-4 EAD?

    To apply for H-4 EAD you need:

    • Form I-765 filled with category (c)(26),
    • Copy of your approved I-140 notice,
    • Your H-1B approval notices showing 6-year cap usage or I-140 approval,
    • Her H-4 visa stamp and I-94 record,
    • Passport copies,
    • Two passport photos,
    • Filing fee of $520 unless filing with an I-485. File by mail to the correct USCIS lockbox — filing at a wrong address is a common mistake that causes rejections.

    H-4 EAD (Employment Authorization Document) is available to H-4 visa holders whose H-1B spouse has an approved I-140 immigrant petition or has been granted H-1B status beyond the six-year cap under AC21 portability. The application is filed on Form I-765 with supporting documents proving the H-1B principal’s I-140 approval. Processing typically takes 3–6 months unless premium processing applies. Critically, the H-4 EAD allows unrestricted open-market employment — your spouse can work for any employer, start a business, or freelance without restriction.

    My wife waited almost 14 months for her H-4 EAD because of a backlog at the time. One thing we learned the hard way: file the H-4 EAD application as soon as your I-140 gets approved — do not wait. Also, if your H-4 EAD is expiring and the renewal is pending, she can continue working for up to 180 days under the automatic extension rule as long as you file the renewal before it expires. We almost missed that detail and it would have meant she had to stop working.

    The H-4 EAD rule has been legally challenged multiple times and was nearly eliminated in 2019 before the proposed rule was withdrawn. This regulatory uncertainty is a real concern — many H-4 EAD holders have had to pause careers during litigation. Some families I know deliberately accelerated their green card process specifically to move beyond H-4 dependency. It is also worth knowing that some states issue driver’s licenses to H-4 holders and that your wife can study, volunteer, or start an LLC without the EAD — only paid employment requires it.
