What is the TN visa for Canadians and Mexicans and how is it different from H-1B?

Priya sharma

I am a Canadian software engineer with a job offer from a US company. My friend told me I should look at a TN visa instead of H-1B. What exactly is TN and is it better or worse than H-1B for someone in my situation?

The TN visa is available exclusively to Canadian and Mexican citizens under the United States-Mexico-Canada Agreement (USMCA). It covers specific professional categories listed in the agreement, including computer systems analysts — note that “software engineer” or “software developer” is not explicitly listed but computer systems analysts have been approved for software development roles when framed correctly. TN has no annual cap, no lottery, and Canadians can obtain it directly at a port of entry without prior USCIS petition. It is granted initially for 3 years and renewable indefinitely in 3-year increments. The key limitation: TN is strictly nonimmigrant intent — you cannot use it as a stepping stone to a green card while maintaining valid TN status.

As a Canadian, I chose TN over H-1B and have zero regrets. I walked into the Peace Bridge crossing with my job offer letter, degree credentials, and $56 in hand, and came out 45 minutes later with TN status stamped in my passport. No attorney fees, no lottery anxiety, no 6–9 month wait. The only thing I planned for was the nonimmigrant intent issue — TN holders technically cannot pursue a green card simultaneously, so I spoke with a cross-border immigration attorney about my options before starting. If you eventually want a green card, you will need to switch to H-1B or another immigrant-intent-compatible status.

To get TN at the border as a Canadian you need:

    • Job offer letter on company letterhead describing the role, salary, and that it is temporary,
    • Your Canadian passport,
    • Proof of your qualifications (degree certificate, transcripts),
    • Filing fee ($56 currently). At the border, CBP officer adjudicates on the spot — most decisions take under an hour.
    • Alternatively, your employer can file Form I-129 with USCIS in advance if you prefer a stamped approval before going to the border, but most Canadians simply go to the port of entry.

The TN vs H-1B debate has a clear answer for most Canadians in the short term: TN wins on speed, cost, and simplicity. But long-term, TN has a structural problem — it signals nonimmigrant intent, meaning if you simultaneously file for a green card, CBP could deny your TN renewal on the grounds that you clearly intend to immigrate. The workaround many immigration attorneys use is to have your employer file an H-1B petition while you are on TN, then switch once selected in the lottery. TN is excellent for 2–5 years of US work experience, but plan your long-term immigration strategy before assuming TN is permanent.
